General Terms and Conditions
Valid for bookings made from 15 December 2016


Dear Guests,

We would like to inform you of the terms and conditions that apply to bookings at Landhaus Alwine. Unless otherwise stated, they form part of every booking. Specific booking conditions, for example those applicable on booking portals, take precedence.

 

General Terms and Conditions (GTC) for Alwine – Landhaus an den Spreewiesen

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded with Landhaus Alwine, provided that they meet the criteria of the German Act on General Terms and Conditions (AGB-Gesetz). They may be replaced by terms individually negotiated in a particular case.
These GTC are displayed clearly and in a generally visible location at Landhaus Alwine and can also be viewed on the Landhaus Alwine website. A separate copy will be provided to the guest or client upon request.

2. Booking

The accommodation contract is deemed to have been concluded once the guest has reserved a room by telephone, email or fax and we have confirmed the reservation. Confirmation may likewise be provided by telephone, email or fax or, upon request, by post.
Under the contract, we undertake to keep the rooms booked by the guest available and to provide the agreed services.
If Landhaus Alwine has reasonable grounds to believe that the guest may jeopardise the smooth operation or safety of the property, or in the event of force majeure (e.g. fire, environmental disaster, etc.) or other circumstances beyond the control of Landhaus Alwine that make it impossible to fulfil the contract, the guesthouse may cancel any reservation without being liable for damages.

3. Payment and Prices

As a general rule, the full invoice amount is due on the day of arrival. Advance payment may be required.
Credit cards and EC cards are accepted.
In the event of early departure, regardless of the reason, the full amount remains payable.
Our current price list applies. Liability arising from information provided in brochures or on the internet is excluded.
We may change the prices if, after booking but before the start of the stay, the guest requests a change to the number of rooms booked, the services provided or the length of stay, and we agree to that change.

4. Cancellation Policy

Cancellations must generally be made in writing, by email, letter or fax.
If the customer cancels the booking up to 7 days before arrival, no cancellation fee will be charged.
For cancellations made between 6 and 3 days before arrival, a cancellation fee of 30% of the total invoice amount will be charged.
For cancellations made less than 3 days before arrival, a cancellation fee of 80% of the total invoice amount will be charged.
The cancellation charges will be reduced by any amounts received by Landhaus Alwine from re-letting the cancelled rooms for the dates originally reserved.
The stated cancellation charges also apply if the guest cancels only part of the reserved services. In such cases, the stated percentages apply to the part of the services that has been cancelled. They also apply if the guest fails to use the reserved services without expressly cancelling them.

5. Arrival

Rooms are available from 3:00 pm.
Earlier arrival is possible in all cases. You may leave your luggage with us and park your vehicle. If your room is already ready for occupancy, you are of course welcome to check in earlier.
We kindly ask you to arrive no later than 9:00 pm on the day of arrival. If you are delayed, please inform us by telephone in good time.
In order to minimise losses, we reserve the right to release the room for other bookings from the following day if the guest has neither contacted us nor arrived by then.
For booking purposes, the day of arrival and the day of departure together count as one day; in other words, the number of overnight stays is decisive.

6. Parking

We provide parking spaces where available. However, there is no entitlement to a parking space.
Parking spaces must be used in such a way that other vehicles are neither obstructed nor damaged.
Landhaus Alwine is not a tour operator.
Where a parking space is made available to a guest, this does not constitute a safekeeping agreement. We accept no liability for loss or damage occurring in front of or on our premises.

7. Pets

Pets are only permitted if this has been confirmed by us in writing.
We kindly ask you not to allow your pet to sleep on the bed, armchair or chairs in your room. Please understand that guests staying after you also wish to sleep in a bed free from pet hair.
We also refer you to our House Rules, which form part of these General Terms and Conditions.

8. Departure

On the day of departure, rooms must be vacated by 12:00 noon and the keys returned to us.
You may leave your luggage with us free of charge until the evening and collect it shortly before your final departure.
If, for reasons for which the guesthouse is not responsible, the room is vacated and the keys are returned after 12:00 noon, 50% of the daily room rate will be charged. After 6:00 pm, 100% of the daily room rate will be charged.

9. Prices

Our current price lists apply.
Unless otherwise stated, all room rates are per night and include breakfast.

10. Jurisdiction and Liability

Landhaus Alwine accepts no liability for the loss of or damage to any property brought onto the premises.
The exclusive place of jurisdiction is the Local Court or Regional Court with jurisdiction for the location of the guesthouse.
German law applies.
The liability of Landhaus Alwine is governed by Sections 701–703 of the German Civil Code (BGB). Liability on any other grounds is excluded unless the damage was caused intentionally or through gross negligence by Landhaus Alwine, its legal representatives or its agents.

11. Severability Clause

Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions of the contract.
The parties undertake to replace any invalid provision with a new provision that, to the extent legally permissible, reflects the intended effect of the invalid provision.
The same applies to any gaps in the contract. In order to remedy such a gap, the parties undertake to agree on a provision that comes as close as possible to what they would have agreed, in light of the meaning and purpose of the contract, had they considered the matter at the time.
